These Terms of Service ("Terms") constitute a legally binding agreement between you and Mockingbird ("we," "us," or "our") concerning your access to and use of the Mockingbird website and AI-powered usability testing services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18, have the legal capacity to enter into these Terms, will comply with all applicable laws, and that all information you provide is accurate and current.
To access certain features, you must create an account. You agree to provide accurate information, maintain your account security, and accept responsibility for all activities under your account. You may not use another person's account or transfer your account.
Mockingbird provides AI-powered website usability testing. Our Service uses AI personas to navigate websites you submit, records session videos, generates usability reports with analytics and heatmaps, and stores test results for your review. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
You agree to use the Service only for lawful purposes. You agree NOT to: test websites you don't own or have permission to test, conduct unauthorized security testing, bypass security features, reverse engineer the Service, upload malicious code, impersonate others, or violate any applicable laws.
The Service and all content, features, and functionality are owned by Mockingbird and protected by intellectual property laws.
You retain all rights to websites and content you submit. By using the Service, you grant us a limited license to access and test your websites, create screenshots and analysis data, store results on your behalf, and use anonymized data for service improvement.
Pricing plans are on our website and may change (not affecting current billing periods). Paid subscriptions are billed in advance on a recurring basis. We offer a 14-day money-back guarantee for new subscriptions; after that, fees are non-refundable except as required by law.
You may cancel your subscription at any time; access continues until the end of your billing period. We may suspend or terminate your access if you violate these Terms, if payment fails, if required by law, or for any reason with 30 days' notice.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI-generated insights should be used as guidance, not a substitute for human testing. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify Mockingbird and its officers, directors, employees, and agents from any claims arising from your use of the Service or violation of these Terms.
These Terms are governed by Delaware law. Disputes shall be resolved through binding arbitration per the American Arbitration Association's rules, except for small claims court.
We may update these Terms. Material changes will be notified by email or through the Service. Continued use constitutes acceptance.
These Terms constitute the entire agreement. If any provision is unenforceable, the rest remain in effect. No waiver of any term is a continuing waiver. You may not assign these Terms without our consent.
